Cr Askew in 5.2 and Cr Sycopoulis in 5.3.

5.1 MAV Workcare Self-insurance Proposal

The Municipal Association of Victoria (MAV) has been developing a Workcare self-insurance scheme proposal since 2012 for the Victorian Local Government sector.

The scheme aims to improve workplace health and safety performance, injury and claims management and reduce workers compensation premiums across the sector.

Members will share the benefits and risks of the scheme which will be overseen by a skills-based MAV Workcare Board.

The Scheme will apply to, and require approval from, the Victorian WorkCover Authority to act as a self-insurer.

The licence will be for three years with a likely renewal term of four years (commitment of seven years in total by participating councils to give financial certainty and time to improve workplace safety performance).

Council has previously agreed to register for the proposal, contributed the required $5000 and agreed for its claims and premium data to be provided to the MAV.

60 councils are required to participate for the scheme to be viable.

Independent actuaries have provided financial projections for the scheme based on recent year’s remuneration, claims and premium data for Victorian councils.

The Scheme is aimed at being operative from 1 July 2016.

Council supported the following recommendation (6-1):

That Council agree to sign the MAV Workcare Participation Agreement.

5.2 Warrnambool Planning Scheme Amendment C97 – West Warrnambool Industrial Precinct – Panel Report

In April 2015, Council received the report of the Panel that considered submissions received to Warrnambool Planning Scheme Amendments C94, C96 and C97 and associated planning permit applications.

The Panel considered the three amendments (rezonings) and the three permit applications, being for the development of a milk processing facility and the development of a cold store facility in Scott Street, and the subdivision of land in Eccles Street.

The Panel supported the three amendments and two of the permit applications for the proposed milk processing facility and cold store, but not the application for the subdivision of land in Eccles Street.

On 5 May 2015, the Minister for Planning announced that he had approved an amendment to facilitate the construction of the proposed milk processing facility and cold store facility in accordance with the recommendations of the Panel.

Council is now only required to consider the recommendations of the Panel in relation to Amendment C97 and associated planning permit (Eccles Street).

Council supported the following recommendations (3-3 with the mayor using his casting vote):

That Council:

1. Pursuant to Section 29(1) of the Planning and Environment Act 1987 (the Act), adopt Warrnambool Planning Scheme Amendment C97 with changes in accordance with the Panel’s recommendations.

2. Pursuant to Section 31(1) of the Act, submit Warrnambool Planning Scheme Amendment C97 to the Minister for Planning for approval.

3. Based on the Panel's recommendations, refuse to recommend to the Minister for Planning that Planning Permit PP2014-0128 be granted to allow a six lot subdivision at Lot 2, PS 702614A, Eccles Street, Warrnambool, on the following grounds:
- Alternative access arrangements have not been adequately assessed.
- The development is likely to have a detrimental impact on the residential amenity of Merrivale Drive by commercial vehicle traffic accessing and egressing the subject land.
- Proposed subdivision plan does not take into account actual title boundaries or location of infrastructure such as power poles and underground services.
- Proposed road pavement widths do not provide for other road functions such as footpaths, street lighting and services.

4. Pursuant to Section 96G(4) of the Act, notify the applicant in writing of the determination to refuse Planning Permit PP2014-0128 and the reasons for the determination.

5.3 Planning Application – 46 Banyan Street Warrnambool

The application is for the construction of two dwellings including the partial demolition, alterations and additions to the existing building.

Five objections to the application have been received.

The proposal was amended from four dwellings to two dwellings on 5 February 2015.

The amended application was re-notified and one additional submission received.

The planning considerations include how the proposal responds to its site and neighbourhood context and the planning policy framework.

The amended proposal is what has been assessed and considered in this report.

Council supported the following recommendation (4-2):

That a Notice of Decision to Grant a Permit be issued for the construction of two dwellings including the partial demolition, alterations and additions to the existing building at 46 Banyan Street Warrnambool, in accordance with Section 64 of the Planning and Environment Act 1987, subject to 14 conditions.

5.4 Bridges Renewal Programme – Ziegler Parade Bridge

A 2011 Bridge Inspection Report identified the need to impose a load limit on the Ziegler Parade bridge in Allansford until major upgrade works can be implemented.

Major upgrade works to remove the current 14 tonne load limit would include repair and reinforcement of the existing concrete bridge structure and upgrade of guard railing and is estimated at $1.2M.

A load limit of 14 tonnes on the bridge structure is currently in place.

An alternative route is being used via the Garibaldi Lane / Princes Highway intersection, which has resulted in road safety concerns related to site distances and school/public transport functions.

Council lodged a grant application under Federal Bridge Renewal Programme (BRP) in August 2014 for a $600,000 grant providing a dollar for dollar basis, which would require Council to match the funding from other sources.

This funding application was successful and has been made available for works in 2015/2016.

Due to budget pressures on the Asset Renewal Programme an allocation to the Ziegler Parade bridge would significantly limit the renewal works in 2015/2016.

State Government funding opportunities related to strategic transport / freight roads are being pursued to secure the necessary funding for the completion of the works to reduce our contribution to this work.

Should the upgrade works not proceed the bridge will continue to deteriorate over time (even with general maintenance) and further (lower) load limits will need to be applied or potentially the bridge closed.

Council supported the following recommendations (7-0):

That Council:

1. Accept the Federal grant offer under the Bridge Renewal Programme of the amount of $600,000 subject to securing State Government funding.

2. Make applications to related State Government funding programs for the necessary funding to complete the bridge works.

5.5 Warrnambool and District Drag Racing Association

Warrnambool and District Drag Racing Association (WDDRA) has been conducting drag race events at the Warrnambool Airport since 2003.

Council advised WDDRA in 2009 that the airport would not be available for use as a drag race facility once the Warrnambool Airport Redevelopment Plan is completed.

Sharp Airlines has been conducting regular passenger transport flights in and out of Warrnambool Airport since 1 February 2015, and has indicated that it would prefer drag racing activities not to occur at the airport.

WDDRA has, with Council, been working towards establishing an alternative site in Moyne Shire to relocate its drag racing activities.

WDDRA is now seeking advice from Council regarding its future use of the airport.

Council supported the following recommendations (7-0):

1. That Council advise the Warrnambool and District Drag Racing Association that it approves use of Warrnambool Airport for drag racing for the 2015/16 season on the following conditions:
- That approval for use will only be granted for one season in advance.
- That approval will also be subject to any conditions that the Civil Aviation Safety Authority may impose via the Aviation Transport Security Act 2004.
- That any future use will be subject to application by WDDRA by 31 August each year prior to the proposed first event of the annual season.
- That Council will consider any future application for use by WDDRA based on the status of the Airport Redevelopment Plan.

2. That Council continues to work with the Warrnambool and District Drag Racing Association to find a new venue for its activities.

5.6 Future of the Dive Pool at AquaZone

The dive pool at AquaZone was decommissioned in 2007 for various operational, risk and maintenance issues.

The AquaZone Strategy 2025 highlighted the need to finalise a decision on the long-term future of the pool given that the structure and plant associated with it remain in place, although decommissioned.

Four options for the long-term future of the pool have been identified, two involving recommission; and two involving completion of decommissioning, with one of these including an alternative activity use (splash pad).

Recommissioning would require investigations to determine if the existing pool structure and plant are sustainable in the long-term.

All four options involve capital cost. The two recommissioning options and the decommissioning option involving the splash pad result in additional recurrent costs.

Guidelines for Safe Pool Operations (the industry standard) include guidelines for supervision of dive pools that would result in a more structured less fun environment for use of the pool.

If the dive pool is fully decommissioned, the resultant space should be used in a way that supports recommendations from the AquaZone Strategy – Option 4 (splashpad) achieves this.

Option 1 - Deepen the existing pool from below through lowering the floor of the pool. The advantage of this option is that it would allow the existing 50m pool filtration system to be reused for the dive pool. Estimated cost: $1,075,000.

Option 2 - Deepen the existing pool from above through raising the sides of the pool and raising the surrounding area to the new height. Increasing the height of the dive pool would create varying water levels between the dive pool and 50m pool. As the dive pool and 50m pool are unable to operate on the same filtration system at different water levels, a separate filtration and balance tank would have to be installed for this option. Estimated cost: $1,075,000.

Option 3 – Complete decommissioning of the facility, fill the space and establish an additional grassed area for patrons using the outdoor 50m pool. Estimated cost: $110,000.

Option 4 – Complete decommissioning of the facility, fill the space but install the infrastructure necessary to establish a splash pad with the base and a minimum number of water features installed, with the opportunity to add additional features in the future. Estimated cost: $550,000.

Cr Askew moved and Cr Gaston seconded an amendment to the motion to include an additional point stating that the dive pool be permanently decommissioned.

Council supported the following recommendations (4-3):

1. That the dive pool be permanently decommissioned.

2. That Council commission detailed design and costs based on demolishing the dive pool structure and reinstating it with a zero depth splash pad with play equipment.

3. That the results from the design and costing work be reported.

5.7 Smoke Free Sports Grounds Program Evaluation

A report outlining the “Readiness for Smoke Free” campaign and the implementation of smoke free areas at Council sporting grounds from April 1 2014 was adopted by Council on 10 June 2014.

The evaluation of the program conducted in late 2014 sought to determine the effectiveness of the introduction of the bans and the “No Butts About It” campaign that promoted the bans.

Surveys to the general public and clubs received 122 responses. The surveys found:
- High levels of awareness of the bans with 91% of respondents aware of it
- 55% were aware of people continuing to smoke at sports grounds
- Over 100 comments were provided in the survey with most very supportive of the bans. Other key comments included enforcement of the bans, designated smoking areas, cigarette butt litter, and signage
- Enforcement of non-compliance, increased signage and consistency are areas recommended for improvement

The feedback has been incorporated into a draft Action Plan for 2015 with ten actions across the following three themes:
- Community Education and Promotion
- Signage
- Enforcement

Council supported the following recommendation (7-0):

That Council endorse the 2015 Smoke Free Sports Grounds Draft Action Plan.
