5.         Reports

 

5.1       Council plan 2013 – 2017: strategic indicators – September quarter  2015/16

Executive summary

The 2013-2017 Council Plan is the principle planning and directional document of the Council and details the Council strategic objectives and strategies over a 4 year period.

The Council Plan sets out the Councils vision in 4 Key Objectives and Strategies to achieve the Objectives across the term of Council.

A range of Strategic Indicators are also included in the Council Plan to monitor achievement of the Objectives across the term of the council plan.

This report sets out progress on the 85 Strategic Indicators that are contained in the current Council Plan 2013-17 for the quarter ended 30 September 2015.

Highlights include:

Major Grants applications submitted for CBD Renewal Project Stage 1

Safer Boating Reference Group final report and options presented to Council

Simpson Street drainage project contract to be awarded

Gilles Street redevelopment tender process completed

Annual Report completed and lodged with Minister for Local Government including new Local Government Performance Reporting Requirements

Endorsement of North Dennington Development Plan

Adoption of Council’s Parking Strategy

 

Council unanimously supported the recommendation below

Recommendation

That Council endorse the Council Plan – Strategic Indicators progress report for the quarter ended 30 September 2015.

 

5.2       September 2015 financial performance report

Executive summary

The Finance Report compares actual financial results against budget for the three months ended 30 September 2015.

The report sets out financial results for Councils Recurrent (day to day operations) Projects, Capital Works, Rates and Loan activities

Year to date budgets are profiled monthly to reflect the timing of cash inflows and outflows.

Overall the three month actual results indicate a favourable financial position of $28,989.

 

Council unanimously supported the recommendation below

Recommendation

That Council endorse the Financial Performance Report for the three months ended 30 September 2015.

 

5.3       Planning Scheme Amendment c100– Warrnambool Cemetery Trust– 582 Hopkins Point Road, Warrnambool

Executive summary

Amendment C100 proposes to rezone land at 582 Hopkins Point Road, Warrnambool from the Farming Zone to Public Use Zone 5.

The Warrnambool Cemetery Trust (WCT) has obtained the relevant consents to use the land for public purposes and has consulted with neighbouring landowners in regard to the intended use of the land for a cemetery and the proposed layout and landscaping of the site.

Given that the amendment will reflect consents already provided to use the land for public purposes, and that the WCT has consulted with neighbours it is recommended that Council resolve to seek the Minister for Planning intervene to prepare and approve the amendment.

If the request for Ministerial Intervention is unsuccessful, it is recommended that Council seek authorisation from the Minister to proceed with preparation and exhibition of the amendment, but without public notice and a shorter notice period to prescribed Ministers in order to expedite the planning process.

 

Council unanimously supported the following recommendations

Recommendations

That Council:

1.         Seek intervention of the Minister for Planning in accordance with Section 20(4) of the Planning and Environment Act 1987 (the Act) to prepare and approve an amendment to the Warrnambool Planning Scheme to rezone land at 582 Hopkins Point Road, Warrnambool, to the Public Use Zone 5 for the purpose of a Cemetery, including removal of the Significant Landscape Overlay Schedule 1 (Amendment C100).

2          In the event that 1. above is unsuccessful, in accordance with Section 8A of the Planning and Environment Act 1987 (the Act), seek the authorisation of the Minister for Planning to prepare an amendment to the Warrnambool Planning Scheme to rezone land at 582 Hopkins Point Road, Warrnambool to the Public Use Zone 5, including removal of the Significant Landscape Overlay Schedule 1 (Amendment C100), and

In accordance with Section 20(1) of the Act, request that the Minister for Planning:

            a)         exempt Council from the need to give notice pursuant to Section 19(2) and 19(3) of the Act and

            b)         approve a reduction in the notice period to prescribed Ministers pursuant to Section 19(1)(c) of the Act to allow a minimum of two (2) weeks between giving of notice and adoption, and       

3          Following the authorisation of the Minister for Planning, proceed in accordance with Section 9 of the Act with the preparation of Amendment C100.

 

 

5.4       Planning Permit Pp2015-0075 – 67 Ryot Street, Warrnambool

Executive summary

The application is for the alterations, extensions and partial demolition of the existing dwelling.  The extension is double storey and designed in a contemporary style.

Six (6) objections and a petition to the application have been received.

The planning considerations include how the proposal responds to the site, the heritage overlay and the planning policy framework.

The application is recommended for approval subject to amendment to the height of the garage wall, overall height of the dwelling, and revision of the colour palette.  The applicant has also proposed a number of further changes to mitigate the potential for overlooking.

The proposal complies with and is supported by the Warrnambool Planning Scheme and relevant policy.

Council supported the following recommendations (5-0)

Recommendations

That a Notice of Decision to Grant a Permit be issued under Section 64 of the Planning and Environment Act 1987 for the land known as 67 Ryot Street for alterations and extension to the existing dwelling and minor demolition in accordance with the endorsed plans subject to the following conditions:

1.         Before the development starts, amended plans to the satisfaction of the responsible authority must be submitted to and approved by the responsible authority.

            When approved, the plans will be endorsed and will then form part of the permit. The plans must be drawn to scale with dimensions and three copies must be provided. The plans must be generally in accordance with the plans submitted with the application but modified to show:

            a)         Reduction in the height of the garage wall to match the existing height of the garage as shown on the proposal plans.

            b)         Reduction in height of the second storey master bedroom by a minimum of 400mm.

            c)         Screening to effectively prevent overlooking into adjoining properties from the balcony, master bedroom and kitchen windows.

2.         Before the development starts, a schedule of construction materials, external finishes and colours to the satisfaction of the responsible authority must be submitted to and approved by the responsible authority.  Colours and finishes are to comprise mid- and dark- tone colours. 

            When approved, the schedule will be endorsed and will then form part of the permit.

3.         At all times during the occupation of the property, screening must be installed and maintained to the satisfaction of the responsible authority.

4.         This permit will expire if one of the following circumstances applies:

            a)         the development is not started within two years of the date of this permit.

            b)         the development is not completed within four years of the date of this permit.

            The responsible authority may extend the periods referred to if a request is made in writing before the permit expires, or within the time prescribed in Section 69 (1 or 1A) of the Planning and Environment Act 1987.

 

5.5       Assembly of councillors records

Report

Section 80A(2) of the Local Government Act 1989 requires the record of an Assembly of Councillors be reported to the next practicable Ordinary Meeting of Council.

The record of the following Assembly of Councillors is enclosed:-

1.         Thursday 8 October 2015 – refer Appendix A.

2.         Monday 12 October 2015 – refer Appendix B.

3.         Monday 26 October 2015 – refer Appendix C.

 

Council unanimously supported an amended recommendation to receive the information with acknowledgement for Crs Neoh and Sycopoulis being on leave and with apologies received for Crs Kelson and Ermacora.

 

5.6       Acting Mayoral & Acting Chief Executive Council Activities – Summary Report

Purpose

This report summarises Mayoral and Chief Executive Council activities since the last Ordinary Meeting which particularly relate to key social, economic and environmental issues of direct relevance to the Warrnambool community.

Council unanimously supported the following recommendation.
