Council confirmed the Minutes of the April 7 meeting (5-2)

4. Declaration by Councillors and Officers of any Conflict of Interest in any Item on the Agenda

Cr Hulin and Cr Ermacora in 5.4, Cr Neoh in 5.7 and Cr Gaston in 5.10.

5.1 Council Plan 2013 – 2017: Strategic Indicators – March Quarter 2014/15

The 2013-2017 Council Plan is the principle planning and directional document of the Council and details the Council strategic objectives and strategies over a four year period.

The Council Plan sets out the Council’s vision in four key objectives and strategies to achieve the objectives across the term of Council.

A range of strategic indicators are also included in the Council Plan to monitor achievement of the objectives.

This report sets out progress on the 85 strategic indicators that are contained in the current Council Plan 2013-17 as at 31 March 2015.

Council supported the following recommendation (7-0):

That Council endorse the Council Plan – Strategic Indicators progress report for the quarter ended 31 March 2015.

5.2 March 2015 Financial Performance Report

The Finance Report compares actual financial results against budget for the nine months ended 31 March 2015.

The report sets out financial results for Council’s recurrent (day to day operations) projects, capital works, rates and loan activities.

Year to date budgets are profiled monthly to reflect the timing of cash inflows and outflows.

Overall the nine month actual results indicate a favourable financial position of $105,516 which is in line with the full year financial forecast.

Council supported the following recommendation (7-0):

That Council endorse the Financial Performance Report for the nine months ended 31 March 2015.

5.3 Warrnambool City Council Draft Budget 2015/16

A Draft Budget for 2015/16 has been prepared and workshopped with Council.

Council is now required to formally prepare the budget.

Public notice of the prepared budget must then be given, copies of the budget be made available for at least 28 days and persons given the opportunity to make submissions in accordance with Section 223 of the Local Government Act.

Council will then adopt the Budget with or without modification in June 2015.

Council supported the recommendations (4-3):

1. That the Warrnambool City Council Budget Report 2015/16 attached to this report and initialled by the Mayor and Chief Executive for identification be the Budget prepared by Council (in respect of the 2015-2016 Financial Year) for the purpose of Section 127(1) of the Local Government Act 1989 as amended (“the Act”).

2. That Council endorse the 2015-2016 Rating Strategy contained within the Warrnambool City Council Budget Report 2015-16.

3. That the Chief Executive be authorised to:

a) Give public notice of the preparation of this Budget in accordance with Section 129 of the Act.

b) Invite interested persons to make a written submission relating to the budget, with written submissions to be received at the Warrnambool Civic Centre not later than 5pm Wednesday 3 June 2015.

c) Make available for public inspection the information required to be made available by Regulation 8 of the Local Government (Planning and Reporting) Regulations 2014.

4. That Council consider any: a) Submissions on any proposals contained in such Budget made in accordance with Sections 129 and 223 of the Act; and b) Recommendations to adopt the 2015-2016 Budget (with or without amendments), and declare rates and charges at a Meeting of Council to be held at 5.45pm, Monday 22 June 2015 in the Council Chamber, Warrnambool Civic Centre, 25 Liebig Street, Warrnambool.

5. That the payment of rates and charges shall be by instalments on the dates specified by the Minister for Local Government under Section 167 of the Act. In addition, Council notes that 30 September 2015, 30 November 2015, 28 February 2016 and 31 May 2016 are the dates on which payment by four instalments of the rates or charges are due.

6. That any person who lodges a written submission and has requested to be heard in support of such written submission be duly heard before a Special Meeting of Council to held at 5.45pm Tuesday 9 June 2015 in the Council Chamber, 25 Liebig Street Warrnambool, with the Chief Executive to be authorised to carry out necessary administrative procedures for this purpose.

7. That Council note that the due date in the 2015-2016 Financial Year for dog and cat registrations under the Domestic (Feral and Nuisance) Animals Act 1994 is on 10 April 2016.

5.4 Warrnambool Planning Scheme Amendment C78 (Implementation of Revised Flood Controls) - Consideration of Submissions

In July 2014, Council exhibited an amendment to the Warrnambool Planning Scheme (Amendment C78) to implement revised flood controls within the Merri River and Russell Creek floodplains.

The amendment attracted 30 submissions. One submission supported the amendment (Glenelg Hopkins Catchment Management Authority). All other submissions expressed concern about the amendment or requested changes.

Prior to the exhibition of Amendment C78, a commitment was made to facilitate the removal of redundant flood controls in areas where no submissions were received.

It is recommended that the amendment be split into two (2) parts to facilitate the approval of parts of the amendment that did not attract submissions (or where submissions can easily be resolved).

All remaining submissions will be referred to a Panel for further consideration following the completion of mitigation works and remodelling of flood levels within the Russell Creek floodplain.

Council supported the following recommendations (3-2):

That Council:

1. Notes the submissions contained in Appendix A.

2. Split Amendment C78 into two parts as follows:
Part 1 - Implementation of flood controls on land that did not attract submissions (or where submissions can easily be resolved) (area shaded GREEN in Appendix C).
Part 2 - Land within the Russell Creek Floodplain (upstream of Bromfield Street - coloured BLUE), land within the South Warrnambool Flood Study (downstream of Block Street - coloured RED) and land within the Merri River floodplain adjoining Membery Way, land at 123 Queens Road, and 2-18 Daltons Road, Warrnambool (coloured PURPLE).

3. Pursuant to Section 29(1) of the Planning and Environment Act 1987, adopt Warrnambool Planning Scheme Amendment C78 Part 1 with changes.

4. Pursuant to Section 31(1) of the Planning and Environment Act 1987, submit Warrnambool Planning Scheme Amendment C78 Part 1 to the Minister for Planning for approval.

5.5 Warrnambool Residential Land Supply Update

Council officers recently undertook an audit of residential land supply across the municipality. This audit is the first detailed land supply audit since the adoption of Council’s City-Wide Housing Strategy in 2013.

The land supply audit confirms that there is adequate zoned land to meet projected population growth until the year 2043 (approximately 28+ years land supply). This equates to an increase of over 25 years land supply within the past decade.

The land supply audit (Appendix A) clearly demonstrates Council’s ongoing commitment to maintaining access to affordable land for residential development. It is recommended that Council endorse the findings of the land supply audit.

Council supported the following recommendation (7-0).

That Council endorse the Warrnambool Residential Land Supply Report 2015 (Appendix A).

5.6 City Renewal – Gilles Street Project

This report provides an update on the Gilles Streetscape, Transport and Amenities Hub Project.

The project involves the design and construction of the Transport and Amenities Hub in Gilles Street.

State Government funding has been received and Outlines Landscape and Architecture have been appointed to design this project.

Four streetscape design options have been developed in consultation with key stakeholders. The stakeholders have a preferred siting of the transport and amenities facilities to be on the eastern side of Gilles Street. The selected siting is considered to be the most suitable in terms of safety, access for all and flexibility of design for future changes.

The next step for the Project is to design the transport and amenities facilities.

Council supported the following recommendations (4-3):

1. That Council endorse the siting of the amenities block and taxi shelter to be on the eastern side of Gilles Street, generally in the location where the current amenities are, and proceed to design of the new amenities block and taxi shelter.

2. That Council defer finalising the Gilles Street design pending further engagement with the stakeholders.

5.7 City Renewal – Warrnambool City Centre Streetscape Design Guidelines

Cr Ermacora was elected temporary chair.

This report recommends adoption of the Warrnambool City Centre Streetscape Design Guidelines – March 2015.

State Government funding has been received for this project.

The guidelines are an initiative of the City Centre Revitalisation – The Structure Plan and are part of an ongoing strategy to improve quality of urban spaces in the city centre.

The guidelines have been expanded and developed from the Liebig Streetscape Plan project and will provide guidance to renewal of the City Centre. The Liebig Streetscape Plan has informed the palette of materials for the guidelines, through significant community consultation and engagement. The palette of materials in the guidelines will be used to reflect each street type and character within the city centre.

Future planning of community infrastructure, maintenance and upgrade works will be informed by the guidelines and will provide a consistent approach. The guidelines apply to the public realm works and will also assist site planning for the private sector. They are also supported by the Liebig Streetscape Committee.

Council supported the following recommendation (5-1):

That Council adopt the Warrnambool City Centre Streetscape Design Guidelines – March 2015.

5.8 Review of Collection Management – Flagstaff Hill Maritime Village

Cr Kelson moved a resolution to amend the first point of the executive summary to remove the reference to local print and social media and replace it so that the first point highlights an advisory committee report in the agenda of the December 1 2014 Council meeting as raising the concerns about the management of the heritage collection located at Flagstaff Hill Maritime Village.

Cr Neoh moved to amend the resolution to remove the first point all together. This was not supported by Council (3-4).

Cr Gaston moved to amend the resolution so that the advisory committee report is included alongside local print and social media reports. This was supported (4-3).

An advisory committee report in the agenda of the December 1 2014 Council meeting, as well as several recent local print and social media reports, has raised concerns about the management of the heritage collection located at Flagstaff Hill Maritime Village (FHMV).

In particular, the reports raise questions about the status of a number of unaccounted for Loch Ard lead ingots, the damage to a Loch Ard copper sheet and the missing ship’s bell from the Newfield.

As a result of these reports and a complaint received by Heritage Victoria, two independent reviews have been conducted by Heritage Victoria and Council’s Internal Auditor, Crowe Horwath.

Both reviews concluded that the collection management practices at FHMV and the evidence provided regarding the missing and damaged items was acceptable.

Crowe Horwath’s report concluded that ‘FHMV collection management are of a high standard. That achieving and maintaining accreditation through the Museum Accreditation Program demonstrates that the management of the collection is at or above the standard expected’.

The Village has approximately 7,500 items in the collection.

The report recommended that Council consider splitting the collection records into collection items of historical or financial value or display props – items of little or no historical or financial value.

Heritage Victoria concluded that ‘many of the issues raised by the complainant have occurred more the 10 years ago’ and noting that this was prior to the current management and accreditation arrangements now in place at FHMV.

FHMV is now undertaking and demonstrating proper management of the collection.

The instigation by Council of internal audit processes is welcomed.

The responses provide by FHMV management are accepted and no further enforcement action will be undertaken in regards to the matters raised.

Council supported the following recommendations (4-3):

1. That Council notes that Heritage Victoria has “… accepted the responses provided by you and does not intend to take any further enforcement actions into the matters outlined……”

2. That Council notes the finding of Crowe Horwath that the Flagstaff Hill Maritime Village collection management are of a high standard.

3. That Council conducts a periodic verification process to ensure the location and condition of higher value items.

4. That Council conduct a periodic sample based verification of lower value assets.

5.9 Freedom Camping – Issues and Policy Forum

Freedom camping under its various definitions is a national issue with a range of views and policy approaches by local governments – primary focus of management is on the amenity of the local community.

Council’s existing policy that guests to the city must stay in registered accommodation places was developed many years ago based around the amenity of the city.

Tourism spend in Warrnambool is major industry.

Continued discussion on Warrnambool’s approach to this issue effects the city’s online reputation amongst paid and freedom campers.

There are a range of views on the best way to address this issue and a public forum will allow all views to be aired providing advice to councillors for future determinations.

Cr Askew moved an amended recommendation where Council releases a discussion paper in order to receive feedback from the community and other stakeholders about the issue in order to determine the next steps required.

Council supported the amended recommendation (7-0).

5.10 Petition for a Dedicated Bicycle Track to Deakin University

This report provides information related to a petition for dedicated bicycle track to Deakin University tabled as Agenda Item 5.13 from the April 7, 2015 Council Meeting.

The Sustainable Transport Strategy has identified this link.

Council’s Open Space Strategy 2013 also identified a link and to investigate a potential trail south of the railway line between Deakin University and the City Centre

An internal working group has been working towards developing a solution to improve access to Deakin University by cyclists.

An application to scope the most cost effective solution (Feasibility Study) was submitted to the TAC Small Infrastructure Grants in 2014 and was not successful.

Currently there is no funding to undertake the necessary Feasibility Study or make improvements to the current route.

Cr Ermacora moved an amendment to the recommendations so that the second recommendation included reference to meeting with Deaking leaders about the issue. She also moved to add a fourth recommendation.

Council supported the following amended recommendations (6-0):

That Council:

1. Respond to the petition provided, acknowledging the community support and advice Council will continue to engage with key stakeholders to determine the most feasible route.

2. Inform Deakin University and the proponent of the current routes available to access Deakin University from the City Centre and seek to meet with Deakin leaders about the issue.

3. Continue to apply for funding to undertake an investigation and scoping of the most cost effective improvements to the current route.

4. Seek to create a working group to develop a joint plan and funding model.

5.11 Community Development Directorate – Six Monthly Operational Report

This report provides a summary of activities undertaken by the Community Development Directorate over the six month period from October 2014 to March 2015.

Highlights include the new mural by world renowned artist Adnate on the South West TAFE building, AquaZone’s work with hospitals to provide rehabilitation facilities for outpatients, the work on the Beyond the Bell education attainment project, over 250 parents participating in the Baby Makes Three program, the new maternal child health centre at Kings College, the Mahogany Kindergarten being officially opened and the work with a community consultation panel to refine the 2015 Fun4Kids Festival.

Council received the report (7-0).
