Council confirmed the Minutes of the Ordinary Meeting of Council held on April 4 2016 and the Special Meeting of Council held on April 18 2016 (7-0).

4. Declaration by Councillors and Officers of any Conflict of Interest in any Item on the Agenda

Cr Kelson declared a conflict of interest in Item 5.4.

5.1 Governance (Meeting Procedure) Local Law No. 1 2016

Pursuant to the Act, Council is required to adopt a Local Law to govern its meeting procedures and use of its Common Seal.

Council‘s current Meeting Procedures Local Law No. 1 was adopted in April 2009. Good governance practice recommends periodic ad-hoc review of local laws to ensure they remain contemporary and consistent with current legislation. With this objective in mind Council in March 2015 commenced a review of its meeting procedure local law.

The review process culminated in a proposed Local Law being presented to Council at its meeting on 7 March 2016 and Council resolved to give public notice seeking community feedback on the draft through a section 223 consultation process.

Two written submissions were received by Council at a Special Meeting on 18 April 2016 and a subsequent final administrative review has now been completed resulting in minor changes to the final draft of the proposed Local Law attached (Appendix A) to this report.

The proposed Local Law incorporates changes in legislation and reflects good governance practice.

The process undertaken to create the proposed Local Law has been in accordance with the statutory provisions of the Local Government Act 1989 and it is recommended that Council resolve to formally make the Governance (Meeting Procedure) Local Law No. 1 – 2016.

Council supported the following recommendations (4-3):

That Council, in accordance with the Local Government Act 1989:

1. Notes the two submissions received during the consultation period for the Governance (Meeting Procedures) Local Law No. 1 2016;

2. Makes the Governance (Meeting Procedures) Local Law No. 1 2016 (Appendix A);

3. Gives public notice of the creation of the Governance (Meeting Procedures) Local Law No. 1 2016 in accordance with section 119(3) of the Local Government Act 1989; and

4. Forwards to the Minister for Local Government, the Hon. Natalie Hutchins MP, a copy of the Governance (Meeting Procedures) Local Law No 1. 2016.

5.2 Council Plan 2013-2017 (as amended 2015): Strategic Indicators – March Quarter 2015/16

The 2013-2017 Council Plan (as amended 2015) is the principle planning and directional document of the Council and details the Council strategic objectives and strategies over a four year period.

The Council Plan sets out the Councils vision in four Key Objectives and Strategies to achieve the Objectives across the term of Council.

A range of Strategic Indicators are also included in the Council Plan to monitor achievement of the Objectives across the term of the council plan.

This report sets out progress on the 85 Strategic Indicators that are contained in the current Council Plan 2013-17 (as amended 2015) for the year ended 30 June 2016.

Council supported the following recommendation (7-0):

That Council endorse the Council Plan – Strategic Indicators progress report for the quarter ended 31 March 2016.

5.3 Warrnambool City Council – Proposed Budget 2016-2017

A Proposed Budget for 2016-2017 financial year has been prepared in accordance with Section 127 of the Local Government Act 1989 (LGA) and is the first budget prepared under the State Government’s “Fair Go Rates System”.

The Budget has been prepared in accordance with the budget principles set down by council and follows a number of workshops by the executive and Council.

As required by the LGA and the Local Government (Planning & Reporting) Regulations 2014 the Draft Budget includes prescribed information, including:

- Financial Statements
- Statement of Capital Works
- Services and Initiatives funded in the budget
- Performance Statement
- Fees and charges
- Rating and borrowing details
- Strategic Resource Plan

Public notice of the prepared budget must then be given, copies of the budget be made available for at least 28 days and persons given the opportunity to make submissions in accordance with Section 223 of the Local Government Act.

Council will then adopt the Budget and the Council Plan with the updated SRP, with or without modification, on 27 June 2016.

Council supported the following recommendations (7-0):

1. That the Warrnambool City Council Proposed Budget 2016-2017 attached to this report and initialled by the Mayor and Chief Executive for identification be the Budget prepared by Council (in respect of the 2016-2017 Financial Year) for the purpose of Section 127(1) of the Local Government Act 1989 as amended (“the Act”).

2. That Council endorse the 2016-2017 Rating Strategy contained within the Warrnambool City Council Budget Report 2016-17.

3. That Council:

a) Give public notice of the preparation of this Budget in accordance with Section 129 of the Act; and

b) Make the Budget and the information required to be made available by Regulation 8 of the Local Government (Planning and Reporting) Regulations 2014 available for inspection at the council civic offices and on Council’s website for at least 28 days, and

c) Invite interested persons to make a written submission relating to the budget, with written submissions to be received at the Warrnambool Civic Centre not later than 5pm Wednesday 1 June 2016, and

d) Hear any person who wishes to be heard in support of a submission at the Ordinary Meeting of Council on Monday 6 June 2016; and

After considering any submissions adopt the 2016-2017 Budget and the Council Plan inclusive of the updated Strategic Resource Plan (with or without amendments) and declare rates and charges at a Special Meeting of Council to be held at 5.45pm, Monday 27 June 2016 in the Council Chamber, Warrnambool Civic Centre, 25 Liebig Street, Warrnambool.

5.4 Draft City Centre Renewal – Free Parking Strategy

Council is presenting the ‘Draft City Centre Renewal - Free Parking Strategy’ (the Strategy) which at its peak will provide over 2500 free car parks in the City Centre.

The Strategy includes:

- 144 free car parks in Parkers from the 1 November 2016 to the 31 December 2017.

- 249 free car parks in Ozone from the 1 November 2017 to the 31 December 2018.

- 10 free 15 minute car parks in Coles Younger car park.

- 220 free car parks at the Railway Precinct Car Park on Merri Street between Fairy Street and Gilles Street in the 2016/17 financial year.

When constructed, this will provide more free parking than paid parking in the city centre with 2,138 of the 4012 car parks free on an ongoing basis.

The Strategy takes into consideration parking issues identified in the Council’s City Centre Parking Strategy, recent free parking trials findings, survey results and current parking data to determine the best model for free parking into the future.

The Strategy not only provides additional free parking alternatives for short term visitors to the City Centre in preparation for, during and after the City Centre Renewal construction periods, but also provides more free parking options for long term parkers such as city centre workers on an ongoing basis.

The free parking proposal forms part of the Business Support Package for the business community that might be affected by the construction works. This will provide support for city centre businesses and visitors before, during and after the City Centre Renewal construction periods with free parking in Parkers, Ozone and Coles at a cost of over $490,000.

Refer to Appendix A for further information and the Strategy.

Cr Sycopoulis moved and Cr Hulin seconded the motion with an amendment to the effect that the Cramond and Dickson car park also be included in the free parking strategy and that free parking commence in all included car parks on November 1 2016 and finish at the conclusion of the city centre renewal works.

Council did not support the amended motion (2-4).

Cr Askew moved and Cr Neoh seconded the original motion. Council supported the following recommendation (5-1):

That the City Centre Renewal Free Parking Strategy be adopted by Council and that a copy be provided to all business owners and operators impacted by the works.

5.5 Additional Free Parking for the City Centre – Railway Precinct

The Railway Precinct on Merri Street has been identified by a number of strategies and plans as an area suitable for an additional car park for the city centre.

It is proposed to construct the Railway Precinct Car Park (Car Park) at 209 Merri Street between Gilles Street and Fairy Street. The land is owned by VicTrack and currently leased by V/Line.

Council has been in discussion with VicTrack and V/Line to construct the Car Park in the 2016/17 financial year subject to the finalisation of a Memorandum of Understanding and Lease agreement.

When complete, the Car Park will provide an additional 220 car parks in an area of high parking demand. Refer to Appendix A.

The 220 car parks will be free, increasing the number of free parking bays in the city centre from over 1918 to over 2138 with the free status of these car parks to be reviewed annually - refer to Appendix B.

Council received the report (7-0).

5.6 Petition for Council to Provide Appropriate Barriers and Signage to Restrict Vehicle Usage in the Jetty Flat Area

A petition has been received containing 208 signatures in relation to restricting vehicle usage at Jetty Flat and environs. Refer to petition Appendix A and location plan Appendix B.

The petition requests that Council erect appropriate barriers and signage to restrict unauthorised vehicles entering Price Street into the areas set aside for recreational activities ie: rail trail and nearby parkland, Cricket Oval and surrounds, BMX track surrounds and caravan Park surrounds. Reasons for this action are as follows:

a. Safety of pedestrians, cyclists and users of recreational/ sporting facilities.
b. Degradation of the area caused by vehicles being driven in erratic and dangerous manner.
c. Noise affecting the quality and quiet enjoyment of this precinct particularly for the local residents.

The petition was presented at the Council meeting held on 4 April 2016.

The area concerned is within the curtilage of the Lake Pertobe Master Plan project area which will take a holistic view of the precinct. As the Master Plan brief has a specific requirement to address traffic management, it is appropriate to consider the merits of additional infrastructure in consultation with all stakeholders as part of the overall master plan process.

The Master Plan project is under way with consultants expected to be appointed by the end of May 2016.

Council supported the following recommendation (7-0):

The petition organisers be notified that traffic management and any resultant new infrastructure be holistically considered within the overall Lake Pertobe Master Plan project currently under way.

5.7 Petition for Council to Provide More Disabled Parking Spaces in the CBD

A petition has been received with 200 signatures for Council to provide more disabled parking spaces in the CBD.

In accordance with Local Law L.1.8.55, the petition is to lay on the table until the next ordinary meeting of the Council on the 6 June 2016.

It is proposed to develop a briefing paper to present at the 6 June 2016 meeting to recommend conducting an internal review and report on disabled parking in the CBD which is to be presented to Council by August 2016.

Council supported the following recommendation (7-0):

That the petition be received. Note: In accordance with Local Law L.1.8.55, the petition will lay on the table until the next ordinary meeting of the Council on the 6 June 2016.

5.8 Community Development Directorate – Six Monthly Operational Report October 2015 to March 2016

This Report provides a summary of activities undertaken by the Community Development Directorate over the six monthly period from October 2015 to March 2016.

Council received the report (7-0).

5.9 Assembly of Councillors Records

Crs Hulin, Kelson and Sycopoulis highlighted errors in appendices A, B and D. Cr Ermacora moved the motion, on the condition that the errors highlighted be investigated and corrected if necessary.

Council received the report (7-0).

5.10 Advisory Committee Reports

This report contains the record of one Advisory Committee meeting: City Health and Wellbeing Community Advisory Committee of Wednesday March 2 2016.

5.11 Mayoral & Chief Executive Council Activities – Summary Report

Council received the report (7-0).

6.1 Notice of Motion No. 2136 – Cr Peter Sycopoulis

Notice is given that at the Ordinary Meeting of Council to be held on Monday 2 May 2016, I propose to move:-

“That the Chief Executive submit a report to the Council before the Ordinary Meeting of the Council on Monday 6 June 2016 to outline the following background facts for the information of all Councillors about the three separate rating schemes that were completed several years ago by the former City of Warrnambool in the Ozone Square car park, the Parkers car park and the Crammond & Dickson car park:

- What were the terms and conditions of these separate rating schemes and what undertakings did the Council provide to the owners and occupiers of the properties that were included in these schemes?

- Is it true that the property owners and occupiers contributed substantial additional rate payments over a period of 10 years in order to achieve free time limited car parking in these three car parking areas and in order for businesses within the CBD to compete on equal terms with the businesses in the Gateway Plaza and similar shopping complexes that provide free car parking facilities?

- On what date did the Warrnambool City Council decide to proceed to install ticket machines to charge motorists for parking in these three car parking areas?”
